Wrongful Death

A Florida Wrongful Death Claim is quite different from other personal injury claims, which means it is easy to become confused, especially in the days following the unexpected loss of a loved one.

At the Law Offices of Jorge L. Flores, P.A., we are also different in the way we deal with the families of those who have lost their lives due to the negligence or intentional acts of others.  In seeking to recover wrongful death compensation, we will meet personally with families to learn as much as possible about the victim and what their loss means to surviving members of the family.  We will also explain in as much detail as necessary, who the potential claimants may be and the damages available to each.

Generally, damages permitted in the Florida Wrongful Death Act include medical, hospital, funeral and burial expenses, as well as compensation for the decedent's pain and suffering, during any period of consciousness between the time of injury and death.

Losses suffered by the decedent's spouse, children or next of kin may also be accounted for, and include:

                loss of financial support

                loss of service

loss of gifts or other valuable gratuities

loss of parental training and guidance

                loss of society and companionship

An unfortunate aspect of Florida wrongful death cases is that sometimes there are disputes among family members as to who shall be the personal representative of the estate, as the personal representative of the estate gets to select the attorney and has greater influence over the distribution of any award of damages.  These disputes can be quite disruptive and unpleasant when families seem more concerned about who gets what, as opposed to the fact that they lost a loved one forever.

During the entire process, we are cognizant and sensitive of the pain felt by the survivors, and offer compassionate but yet aggressive representation throughout the entirety of the wrongful death litigation.  At the Law Offices of Jorge L. Flores, P.A., our team will take the time to make sure you understand every aspect of your case, so you feel comfortable each step of the way, and in the process, we will help you turn your focus and attention back to your loved ones.

Wrongful death claims may arise from a number of unintentional acts or acts of negligence.  For example, automobile accidents, medical malpractice, slip and fall accidents, defective products, aircraft accidents, etc.  On the other hand, wrongful death claims may also arise from intentional acts.  For example, shootings, stabbings, assaults, etc.

At the Law Offices of Jorge L. Flores, P.A., we employ all the professional personnel necessary, such as private investigators, medical experts, accident reconstruction engineers, human factor experts, economists and other professionals who can testify to the cause of the fatal injury as well as to establish the value associated with the lost wages and future income of the deceased.
